when i drive and accelerate, it works exceptional but when it gets to about 40 mph, it seems to lose power and now gain it back until the accelerator pedal is so far down that the overdrive kicks in. I’m wondering what would cause this because this has been giving me grief about solving this mystery.

The first two things that come to mind would be a spark issue that is developing (spark fails under load around 40 – 45 MPH) or the Torque Convertor Clutch if it’s automatic

i forgot to mention that it is more likely to act up when its warm and the code p0440 is on if that has anything to do with it.

The P0440 is an EVAP code and wouldn’t affect engine performance. When was the last tune up performed and how long has it been doing it?

Sounds like the catalytic converter may be starting to plug up.
